KOTA KINABALU: A 26-year-old man pleaded not guilty at the Sessions Court here yesterday to a charge of misusing the money of a company.
Alex James, currently self-employed, was slapped with two charges of criminal breach of trust by Sessions Court judge Azhaniz Teh Azman Teh.
The charges framed under Section 408 of the Penal Code, is punishable with imprisonment for a term which shall not be less than one year and not more than ten years and with whipping, and shall also be liable to fine.
He was charged with two counts of the same offence on two separate occasions while employed as supervisor of Syarikat Group Five Supply and Service Sdn Bhd.
The first count stated that he had misused RM2,000 which his employers had handed to him for safekeeping on April 14 at 2pm at Plaza Tanjung Aru at Jalan Mat Salleh.
On the second count, he was alleged to have taken RM2,700 of the company’s money for his own use on April 17, at 5.35pm near Maybank at Jalan Gaya.
Alex was granted RM12,000 bail with one surety and ordered to report to the nearest police station twice a month until full and final disposition of his case, which is prosecuted by deputy public prosecutor Nartiah F. Mirchelle Sambatan.
The court also set September 19 for re-mention of his case.
In the Magistrate’s Court, a shop assistant yesterday denied a charge of carrying an offensive weapon in public.
Herman Saripuddin, 22, was caught with an eight-inch keris (a Malay dagger) at Jalan Pantai at 3am on August 13.
The charge framed under Section 6(1) of the Corrosive and Explosive Substances and Offensive Weapons Act of 1985, makes him liable to a prison term of up to two years and whipping, if convicted.
Magistrate Stephanie Sherron Abbie granted him bail at RM1,000 with two local sureties and set September 30 for the case management.
