IPhone dealer ordered to refund RM1,470

KOTA KINABALU: The Consumer Claims Tribunal ordered Agotake Marketing Sdn Bhd to refund RM1,470.40 to a claimant for an iPhone that the latter bought from the company.

The claimant, who only wanted to be identified as Chan, said he and his wife bought the iPhone 4S with a capacity of 16GB for RM1,838 on June 27 last year.

In May this year, the couple brought the iPhone back to the company as it could not be switched on.

A week later, the claimant called the company but was told that the device was still under repair.

When the company finally called him to pick up his iPhone, the claimant found that his device was not in satisfactory condition.

Chan said he had complained to Agotake Marketing but was told to deal with another company that was responsible for fixing the iPhone. However, both companies refused to take responsibility for this matter.

Tribunal president Datuk Dr Lawrence Thien ordered the respondent to refund RM1,470.40 to the claimant, 20 per cent off the original price of the phone as the gadget had been used for a year.

The respondent is required to refund the payment to Chan and the device has to be returned to the company.

The respondent was absent during the hearing.

Meanwhile, claimant Belenda Sion was awarded RM185 for karate uniforms and accessories she bought from a seller at Mudah.com which did not match their descriptions.

Belenda said the respondent Agasi Sports World promised that the karate uniform, shin guard and body protector she bought would be brand new.

Upon receiving her orders, the claimant found that the uniform was yellowish, while the shin guard seemed old.

When she called up the seller for an explanation, the claimant was told that the items were the company’s old stock.

In her second purchase with the company, Belenda found that the karate uniform mailed to her was of the wrong size.

She then decided to lodge a case with the Consumer Claims Tribunal.

Thien subsequently ordered the respondent, who was absent during the hearing, to refund RM185 to the claimant after deducting the shipping fees incurred.
